Myths and falsehoods surrounding the Sotomayor nomination

The media have advanced numerous myths and falsehoods about Sonia Sotomayor. In addition to evaluating these claims on their merits, the media should also consistently report that conservatives were reportedly very clear about their intentions to oppose President Obama's nominee for political purposes, no matter who it was.

Whether born from experience or inherent physiological or cultural differences... our gender and national origins may and will make a difference in our judging.

most benefit of institutional favoritism in the US is towards the children of alumni.

For example:

True, George W. Bush attended Yale and Harvard Business School. Being the son of a millionaire oilman (and later congressman, CIA director, and President) and the grandson of a Senator, both of whom attended Yale, probably had a little something to do with that - especially given that he never made the honor roll at the elite prep school his family connections got him into.

Facts probably mean little to you but:

1. Sotomayor commuted to the parochial Cardinal Spellman High School in the Bronx, where she was on the forensics team and was elected to the student government.[15] She graduated asvaledictorian in 1972.

2. She won the Pyne Prize, the top award for undergraduates, which reflected both strong grades and extracurricular activities.[15][10] She was also elected to Phi Beta Kappa.[10] She earned her A.B. from Princeton, graduating summa cum laude in 1976.

3. Sotomayor entered Yale Law School in fall 1976, where she became an editor of the Yale Law Journal

These are extraordinary achievments. No amount of "undeserved advantage" has anything to do with anyone's ability to accomplish these things.

Barack Obama was elected president. He will nominate who he chooses for all the posts that require his nomination. Get over it.

Yes, rich families tend to do quite well. Using That as a comparison does nothing for your case. How about the fire fighters in New Haven Connecticut? The promotional tests were thrown out because no minorities passed the test. It is just an example and I am not saying that minorities are incapable, just be fair about it.

If a white man made the statement that she did they would not be getting the job.

I read the case and as I understood it, (in Jen's terms) Ricci's argument was that Whites were denied because no Blacks succeeded. The counter argument seemed to be we can throw out any test we want. If any test can be thrown out,then it does not matter who passed or failed or why you think it was tossed. If they can throw out a test, they can throw out a test. It sounded like the courts said they do have the right to throw out a test. Hayden v. County of Nassau, 180 F.3d 42 (2nd cir. 1999) was one of the cases used for the decision.

      it may be, and businesses and governments have had the upper hand when it comes to making decisions about their employees for a long, long time.

      It is within the law for any institution to throw out any test at any time and they threw out this test because it wasn't certified. And on top of that they had test evaluators come in and say the test was flawed. So the city would have gotten sued regardless.

          This is Obama's OWN words last night in L A about this pick for the Supreme Court. Never mind that she has been reversed over 60 % of the time in her opinions, never mind the fact that she did indeed say that as a Latino woman she will do a better job, (imagine if Samuel Alito or John Roberts had said that about him being a white man as opposed to African Americans or Latinos) never mind her saying that "policy is made" on the courts... never mind all that . This is what Obama said last night.

          Just a question or two. Why did he say that? Is this to imply that for the last __— years no one on the Supreme Court has provided justice? Is it because it's his pick - now they will have REAL justice? And what opinions have been rendered that have not been just? ..."and starting to provide some justice"- How arrogant and what a slam for those who are currently sitting or have sat on the bench. Truly an unbelievable ignorant remark!

          Some people don't like the fact that others think words mean something. Some think that others pick on this President too much. But with statements like these??...Look, I am sure these words mean something to the POTUS and I am not sure what it is he meant, but it sure doesn't sound good. How can anybody take these words he spoke and see anything good coming from them?

          Let's see what you have.
